This page (together with the documents referred to on it) tells you the terms and conditions on which we supply any of the products (Products) listed on our website www.citybathrooms.biz (our site) to you. Please read these terms and conditions carefully before ordering any Products from our site. You should understand that by ordering any of our Products, you agree to be bound by these terms and conditions. You should print a copy of these terms and conditions for future reference. THESE TERMS DO NOT AFFECT YOUR STATUTORY RIGHTS 1. HOW THE CONTRACT IS FORMED BETWEEN YOU AND CITY BATHROOMS 1.1 After placing an order, you will receive an e-mail from us acknowledging that we have received your order. Please note that this does not mean that your order has been accepted. Your order constitutes an offer to us to buy a Product. All orders are subject to acceptance by us. The contract between us (Contract) will only be formed when we dispatch your items. 1.2 The Contract will relate only to those Products we dispatch to you. We will not be obliged to supply any other Products which may have been part of your order until those Products become available to us for dispatch. 2. CANCELLATION 2.1   To cancel a Contract, you must inform us in writing. You must also return the Products to us immediately, in the same condition in which you received them, and at your own cost and risk. You have a legal obligation to take reasonable care of the Products while they are in your possession. If you fail to comply with this obligation, we may have a right of action against you for compensation. 3. PRICE AND PAYMENT 3.1   The price of any Products will be as quoted on our site from time to time, except in cases of obvious error. 3.2   These prices include VAT but exclude delivery costs, which will be added to the total amount due as set out in our Delivery Options page. If the rate of VAT changes between the date of your order and the date of delivery, we will adjust the VAT you pay, unless you have already paid for the Products in full before the change in VAT takes place. 3.3   Prices are liable to change at any time, but changes will not affect orders in respect of which we have already sent you a Dispatch Confirmation. 3.4   Our site contains a large number of Products and it is always possible that, despite our best efforts, some of the Products listed on our site may be incorrectly priced. Where a Product's correct price is less than our stated price, we will charge the lower amount when dispatching the Product to you. If a Product’s correct price is higher than the price stated on our site, we will either contact you for instructions before dispatching the Product, or reject your order and notify you of such rejection. 3.5   If the pricing error is obvious and unmistakable and could have reasonably been recognised by you as an error, we do not have to provide the Products to you at the incorrect (lower) price 4. SHIPPING AND COLLECTION 4.1 Our home delivery service options and pricing will be explained at the point of order. 4.2 Please allow up to 5 working days (weekend and public holidays excluded) from when you receive your order confirmation to receiving your order. If City Bathrooms foresees any reason why your order will not be shipped within the stated timescales, we will endeavour to contact you. Although we endeavour to deliver over 95% of orders within the Delivery Times stated, these times are a guideline only, and are not guaranteed. It should be noted that delivery may in some cases take up to 28 days depending on stock. 4.3 Items heavier than 1kg will be dispatched with a courier 4.4 Items less than 1kg will be dispatched with Royal Mail 4.5 Collection may be available from our store Free of Charge 3 days after you receive your order confirmation, please contact us by email for confirmation of collection address. 6.6 Delivery is restricted to the following: England, Scotland, North Ireland and Wales 4.3 You shall be responsible for making all necessary arrangements to take collection of the Goods. 4.4 Any specific, or exceptional, delivery requirements should be agreed prior to purchase. 4.5 Delivery charges for orders outside mainland Britain or in the Highlands of Scotland may vary. 4.6 If you fail to take delivery of the Goods or fail to give us adequate delivery instructions on the date agreed for delivery, then we reserve the right to charge you the subsequent delivery charges. 4.7 We recommend that you do not confirm the start date with your installer until you have received and checked your delivery. If you do not check your delivery is correct before Installation starts City Bathrooms will not accept liability for any additional costs that you incur while any product Issues are resolved.  6.8 You agree to accept delivery within 30 days of the date you make payment in full for your order unless otherwise agreed. We reserve the right to charge storage charges at the rate of 2% of the total order per month if orders are delivered outside 30 days. 6.9 Risk of damage to, or loss of the Goods shall pass to you at the time we deliver to your agreed delivery address or you make collection from the City Road Bathrooms showroom. 7. RETURNS POLICY 7.1 Faulty or damaged goods will be replaced or refunded in full in accordance with the Distance Selling Regulations of 2000. Before returning any goods to us please contact us by email or click the "contact seller" button in the listing. 7.2 Faulty or damaged goods will be replaced or refunded in full in accordance with the customer's requirements. If only part of the item is damaged we will send out a replacement for the part that is damaged or faulty. In the event that a part cannot be sent, the whole item will be replaced. 7.3 Please make sure all goods are returned in their original condition with all the original packaging within 7 days of receiving your order. 7.4 We will not pay for unwanted goods to be returned. Goods can be returned by courier or registered post, or we can arrange for collection (collection fee to be paid by customer). 7.5 If the item is returned which is listed with free postage, we will deduct £7 handling fee from the refund. 7.6 In the event of faulty goods or missing items we will in no way be liable for any related expenses such as plumbers or electrician's fees, loss of earnings etc. 7.7 We have the right to refuse refunds if they do not meet the above criteria. 8. WARRANTY AND LIABILITY 8.1 Proof of purchase is required before any warranty claim can be assessed. 8.2 We shall make good by reimbursement of the whole or part of the price or, at our option, by repair or by replacement any defect developing under normal domestic use of the Goods within the stated guarantee period for the product effected. 8.3 We shall make good by reimbursement of the whole or part of the price or, at our option, by repair or by replacement any defect developing under normal domestic use of the Goods within the 12 month period after delivery. 8.4 Save as provided elsewhere, our liability for death or personal injury caused by our negligence shall be unlimited and for all other loss or damage which you may suffer or incur in connection with the supply of Goods, our liability shall be limited to that caused by a natural and reasonably foreseeable consequence for which we are at fault or negligent. 9. GENERAL 9.1 We shall have no liability whatsoever for any failure to perform, or for a delay in the performance of any of our obligations under the Contract arising wholly or in part by reason for any factor beyond our direct control. 9.2 In placing an order with us, you warrant that you are a resident of the United Kingdom and that you have the necessary permission and authority to enter into this Contract. 9.3 Where any competent authority deems any Condition to be invalid or unenforceable in whole or in part, then the offending part shall be removed and the validity of the remainder of the Condition shall not be affected. 9.4 These Conditions do not purport to confer a benefit on any third party by virtue of the Contracts (Rights of Third Parties) Act 1999 by any person that is not a party to it. 9.5 The Contract and these Conditions shall be governed by the laws of England, and you agree to submit to the non-exclusive jurisdiction of the English courts. 9.6 Any notice required or permitted to be given by either party to the other under these Conditions shall be in writing addressed to the other party and delivered to the address provided at the time the order is confirmed or any subsequent or alternative address which one party may notify to the other from time to time. 9.7 The terms and conditions do not affect your statutory rights. PRICE MATCH GUARANTEE At City Bathrooms we are confident that our prices will be the lowest. If you find the same model and brand of any product cheaper at another store (physical and online), we will match the price . - We will match the third party price quote. - All we ask is that you apply before your purchase or within 14 days of purchase from us. Where applicable a City Bathrooms proof of     purchase (receipt) is required. - Your claim must be supported by a written quotation for the relevant product from the competing retailer or direct link to the   product page if online. - City Bathrooms will only beat quotes from competing high street retailers or online web stores. - Price quotes will only be beaten for each eligible item purchased from us. - The product(s) must be be the same brand and model, in colour, size or any other product option. - The comparison will be made against the actual City Bathrooms price including any discounts or offers applicable at the time the   application is made. - The price guarantee excludes installation and delivery charges. - Special Offers, Clearance offers or any other limited time only offers from the competing supplier are excluded. - City Bathrooms reserve the right to withdraw or amend the City Bathrooms price match guarantee at any time without notice.
